The Solution To Hidden Defects | Nordgren Law: Automotive Litigation and Lemon Law

With every item you purchase, there is an implied warranty that the item does not contain hidden defects at the time of sale. If your car, or any other purchase for that matter, is causing you problems, this warranty may have been breached.

When an implied warranty against hidden defects is breached, you may bring what is called an action in redhibition to either rescind the sale or reduce the purchase price, provided the defects were not known to you at the time of purchase and that you would not have bought the item if you had the information you now have.

A consumer simply needs to provide the seller notice and a reasonable opportunity to repair the defect. If problems still exists, it may be time to consult an attorney.
